Service Agreement for WTSolutions - "Images to Google Earth/Ovi Maps"

1. Acceptance of Terms

By accessing or using the "Images to Google Earth/Ovi Maps" software (the "Service") provided by WTSolutions ("we," "us," or "our"), you agree to be bound by this Service Agreement ("Agreement"). If you do not agree to these terms, you must not use the Service.

2. Description of Service

"Images to Google Earth/Ovi Maps" is a cross-platform image EXIF information processing software that allows users to import photos into Google Earth/Ovi Maps. The Service supports Windows, Mac, iOS, Linux, and Android systems and requires no download or installation. It reads GPS information from photos and generates KMZ files compatible with Google Earth/Ovi Maps, enabling the display of photos at their corresponding locations based on the GPS information (Geotag) of each photo. Additionally, GPS data can be exported to CSV or GeoJSON format files.

Service Limitations and Explanations:

The Service only processes existing GPS information in photos and does not create or modify GPS data.
The accuracy of GPS data depends entirely on the photo capture device and environment. WTSolutions makes no guarantees regarding the precision, accuracy, or reliability of GPS data.
Generated file formats (KMZ, CSV, GeoJSON) may have compatibility issues. Users must test and verify them independently.
The features provided by this Service are for general use only and are not suitable for any professional measurement, navigation, or commercial purposes with strict data accuracy requirements.
The Service may not function properly due to network, device compatibility, or other technical reasons. WTSolutions does not guarantee continuous availability of the Service.
Regular users can process up to 6 photos at a time. Premium users have no restrictions.

3. User Responsibilities

You agree to use the Service in compliance with all applicable laws and regulations. You are solely responsible for:

Ensuring that you have the necessary rights to use and process the photos you upload.
Maintaining the security of your device and data.
Using the Service in a manner that does not infringe on the rights of others or violate any laws.
Bearing full responsibility for all results generated from using the Service, including but not limited to any losses or damages caused by inaccurate GPS data.
Independently verifying the accuracy and applicability of any files generated by the Service (such as KMZ, CSV, GeoJSON, etc.) before use.
Understanding and accepting that the GPS data provided by this Service may contain errors and is not suitable for professional or commercial purposes with strict data accuracy requirements.
Ensuring compliance with relevant laws and regulations and bearing corresponding commercial risks if using the Service for commercial purposes.
Not using the Service for any illegal activities, including but not limited to infringing on others' privacy, stealing trade secrets, etc.

You expressly understand and agree that any consequences arising from using this Service (including but not limited to economic losses, equipment damage, data loss, etc.) shall be borne by you alone, and WTSolutions assumes no liability whatsoever.

4. License and Restrictions

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service solely for your personal or internal business purposes. For Pro features, a Pro Code is required. You agree not to:

Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Service.
Distribute, sublicense, lease, rent, or otherwise transfer the Service to any third party.
Use the Service for any illegal or unauthorized purpose.
Share or transfer your Pro Code to another user.

5. Intellectual Property

The Service, including its software, design, and content, is owned by WTSolutions and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for personal or internal business purposes. You may not copy, modify, distribute, or reverse-engineer the Service without our prior written consent.

6. Payment Processing and Refunds

For purchases made through the Service, we use Stripe as our payment processor. By completing a purchase, you agree to the following:

Stripe will process your payment information in accordance with its Terms of Service and Privacy Policy.
You authorize Stripe to collect and store your email, payment method details, and transaction information to complete the transaction.
WTSolutions does not store or have access to your full payment details. All payment information is securely processed by Stripe.
WTSolutions is not responsible for any errors, delays, or issues arising from Stripe's payment processing services.

Refund requests will be handled in accordance with our refund policy. Please note:

One day free trial is provided upon request.
Subscription refund requests must be submitted within 7 days of the purchase date.
Subscription refund requests must include a valid proof of purchase, such as a receipt or invoice.
Subscription refund requests may be subject to a 10% processing fee, and the processing might take 1 ~ 2 business days.
One-time purchase (buyout) does not support refunds.

7. Subscription and Purchase

We offer two types of premium feature access codes: subscription and one-time purchase (buyout).

7.1 Subscription (Online Version Only)

Subscription can be used on up to 10 devices and includes access to the latest version updates.

7.2 One-Time Purchase (Desktop Installation Version Only)

One-time purchase can be used on a single device and provides permanent access after purchase. It does not include major version updates (for example, if you purchase at v2.0.0, you can use v2.0.0 and subsequent versions, but not v3.0.0 and later versions).

8. Privacy

Your use of the Service is subject to our Privacy Policy, which explains how we handle your information. The Service operates entirely on your local device and does not collect, store, or transmit your photos, GPS data, or personal information to our servers or third parties. 9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. WTSolutions does not guarantee that the Service will be error-free, uninterrupted, or compatible with your device. You bear full responsibility for all results generated from using the Service.

Special Disclaimer:

GPS information in photos may contain errors or inaccuracies. WTSolutions makes no guarantees regarding the accuracy, completeness, or reliability of GPS data.
Generated KMZ, CSV, or GeoJSON files may contain errors or inaccurate information. Any consequences resulting from using these files are borne by the user.
WTSolutions assumes no liability for any commercial losses, data loss, equipment damage, or other direct or indirect losses caused by using this Service.
Users should independently verify the accuracy of GPS data and perform necessary checks and confirmations before use.
This Service is not suitable for any professional or commercial purposes with strict data accuracy requirements. For high-precision data, please use professional measurement equipment and services.

10. Limitation of Liability

To the fullest extent permitted by law, WTSolutions shall not be liable for any of the following damages:

Direct damages: including but not limited to equipment damage, data loss, software failure, etc.
Indirect damages: including but not limited to loss of profits, business opportunities, revenue, etc.
Incidental, special, consequential, or punitive damages.
Any losses or damages arising from the use or inability to use the Service.
Any losses caused by inaccurate GPS data, file format errors, or other technical issues.
Any losses arising from your violation of this Agreement or applicable laws and regulations.

In any case, WTSolutions's total liability to you shall not exceed the amount you paid for using the Service. If no payment was made, WTSolutions assumes no liability whatsoever.

11. Indemnification

You agree to indemnify and hold harmless WTSolutions, its affiliates, and their respective officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses, including reasonable attorneys' fees, arising out of or related to your use of the Service or violation of this Agreement.

12. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for any reason, including but not limited to your violation of this Agreement. Upon termination, all rights granted to you under this Agreement will immediately cease. The Service does not store your data, so no action is required to retrieve or delete your information.

13. Changes to This Agreement

We may update this Agreement from time to time. Any changes will be posted on this page with an updated effective date. Your continued use of the Service after the changes constitutes your acceptance of the revised Agreement.

14. Governing Law and Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of P.R.China, without regard to its conflict of law principles. Any dispute arising out of or relating to this Agreement shall be first resolved through amicable negotiations. If negotiations fail, the dispute shall be submitted to the competent court in the location of WTSolutions.

16. Entire Agreement

This Agreement constitutes the entire agreement between you and WTSolutions regarding the use of the Service and supersedes any prior agreements or understandings, whether written or oral.
